Terms of Service

These Terms of Service ("Terms") govern your use of Tusile — including the Tusile mobile and desktop apps, the web app at app.tusile.com, and the Tusile Core hosted services (account management, server discovery, licensing, billing). By creating an account or using any part of the service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age required by applicable law in your country) to use Tusile. By using the service you confirm you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

We may remove content or suspend accounts that violate these rules, at our sole discretion, with or without prior notice.

4. User content

You retain ownership of content you post (messages, files, images). By posting content through Tusile Core services (e.g. profile information, content visible through server discovery), you grant Tusile a limited, royalty-free licence to store, display, and transmit that content solely as necessary to operate the service.

You are solely responsible for the content you post. We do not actively moderate content on self-hosted community servers — that responsibility belongs to the server owner. For Tusile-hosted servers, we may remove content that violates these Terms. We do not endorse any user-generated content.

5. Community servers

Tusile community servers may be self-hosted by independent third parties ("server owners") or hosted by Tusile directly on our managed infrastructure.

Self-hosted servers. Self-hosted server owners are responsible for their servers' content, moderation, and compliance with applicable laws. Every self-hosted server connected to Tusile Core operates under a Tusile server license; the free Party license applies by default. A license never limits how many members can join a server and does not gate any feature of the server software — members, messages, file uploads, voice, video, and roles always work in full. What a license governs is the Tusile Core services delivered to your server: listing in public server discovery and Tusile Core push-notification delivery. Both apply while the server's member count is within the licensed tier's threshold; a self-hosted server that grows past its threshold is removed from public discovery and its push notifications pause until it is back within the limit or moves to a higher tier. The free Party license carries a threshold of its own, so a server on it is publicly listed while it stays within that threshold. Paid licenses (see Section 6) set a higher member threshold up to which a server stays publicly listed and continues to receive push.

Licenses are bound to a specific server and installation and are non-transferable. Circumventing or tampering with license validation, misrepresenting member counts, or interfering with the audit mechanisms of Tusile Core is prohibited.

Tusile-hosted servers, free tier. Tusile offers free community servers hosted on our own managed infrastructure. Free hosted servers are subject to a 10-member limit and a 50 MB per-file upload limit. They are eligible for public server discovery on the same terms as any other server, and because they remain within their member limit they always receive push notifications. Free hosted servers share one machine. While that machine is busy, voice and screen video published from calls and screen shares started on it are capped (currently 720p at 24 frames per second, and 32 kbps audio) until the machine is no longer busy. No feature is disabled by this. The server owner remains responsible for their community's content and moderation within the bounds of these Terms. Tusile may suspend or terminate free hosted servers that violate these Terms, generate repeated abuse reports, or remain entirely inactive for an extended period, with or without prior notice. Tusile provides no uptime or availability guarantee for free-tier hosted servers.

Tusile-hosted servers, paid. Tusile also offers paid managed hosting, sold as a subscription under Section 6. A paid hosted server runs on Tusile infrastructure at a subdomain of a Tusile-owned domain, includes a server license at the tier stated on the pricing page, and has no limit on how many members may join. Each hosting plan states a recommended member count; this is a guide to the resources allocated to your server and not a cap. Exceeding it never blocks joins and never disables a feature. If the machine your server runs on is busy at the same time as your community is above its recommended count, outgoing video quality is capped (currently 720p at 30 frames per second) until the machine is no longer busy; on a quiet machine nothing changes at any size. Moving to a larger plan, where one is available, lifts the cap. Public discovery and push notifications follow the license rules above.

6. Paid subscriptions and billing

Tusile sells two kinds of paid subscription: server licenses (currently the Guild and Server tiers), which apply to a server you run yourself, and managed hosting, under which Tusile runs the server for you and which includes a server license at the tier stated on the pricing page. Both are billed monthly or yearly through our payment processor, Stripe, and payments are subject to Stripe's own terms. Current prices and thresholds are listed on the pricing page. Prices may change; we will give advance notice of any price change, which takes effect from your next renewal. Applicable taxes may be added depending on your location. The terms below apply to both kinds of subscription except where they say otherwise.

7. Tusile Core services

Tusile Core provides account management, server discovery, license validation, and billing. Payment processing is handled by Stripe. We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of Tusile Core at any time. Where practicable we will provide advance notice of significant changes.

8. Intellectual property

The Tusile name, logo, app, and website are owned by Tusile (Karol Rzotki). Nothing in these Terms transfers any ownership rights to you. You may not use our name or logo without prior written permission, except as needed to truthfully describe the software you are using.

9. Disclaimer of warranties

The service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or secure. Your use of the service is at your own risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, Tusile and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of — or inability to use — the service, even if advised of the possibility of such damages.

11. Termination

We may suspend or terminate your account if you violate these Terms or if required to do so by law. You may stop using the service and delete your account at any time. Sections 4, 8, 9, 10, and 12 survive termination.

12. Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of Poland, unless mandatory consumer-protection law in your country provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. If the changes are material we will make reasonable efforts to notify you (e.g. via the app or email). Continued use of the service after the effective date constitutes acceptance of the updated Terms.
